THE FOLLOWING TERMS AND CONDITIONS ARE APPLIED TO esbsite.org ACCOUNTS
1. ACCEPTANCE OF esbsite.org TERMS
Welcome to esbsite.org! By requesting a membership account on esbsite.org, you agree to these terms, and you further agree to comply with the esbsite.org Community Guidelines ( Community Guidelines) located at http://www.esbsite.org/guidelines.jsp.
WSO2 Inc. (WSO2), as the owner of esbsite.org, reserves the right to update and change these Terms and all documents incorporated by reference at any time. You can always find the most recent version of the Terms at http://www.esbsite.org/terms.jsp.
2. DESCRIPTION OF SERVICE
2.1 esbsite.org
esbsite.org provides members with the ability to share extensions, articles, code snippets, patches and any other information related to the WSO2 ESB and Apache Synapse ESB. WSO2 reserves the right to remove any dangerous or socially unaccepted code or resources that may be harmful to users. WSO2 reserves the right to remove or bar a member for any reason, such as non-compliance with the esbsite.org Community Guidelines.
3. esbsite.org ACCOUNTS
To participate in esbsite.org, you must have a valid email address. In consideration of your use of esbsite.org, you agree to: (a) provide true, accurate, current and complete information about yourself and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or WSO2 has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, WSO2 has the right to suspend or terminate your esbsite.org account and delete any information or content therein without liability to WSO2.
By providing us with a valid email address you agree that WSO2 may contact you at that address for purposes of managing and maintaining your esbsite.org account. In addition we reserve the right to send announcements regarding esbsite.org and WSO2 products & services to that account. WSO2 will not sell your email address or provide it to third parties without your prior approval.
4. PAYMENT TERMS
4.1 General Terms
esbsite.org beta is currently a free service. WSO2 Inc. retains the right to cease offering free memberships at any time, to transition current accounts to paid subscriptions when the beta period ends, to convert existing features to premium (paid) features, or to introduce new premium features. Users of the beta are under no obligation to subscribe to a paid account, in which case esbsite.org reserves the right to suspend or terminate the member account.
4.2 Cancellation of Membership
Memberships can be cancelled online at any time. Any difficulty encountered with deleting a membership account should be addressed to the esbsite.org support group, whose contact information can be found at http://www.esbsite.org/support.jsp.
5. esbsite.org's RESERVATION OF RIGHTS
WSO2 expressly reserves the right to immediately modify, delete content from, suspend or terminate your account and refuse current or future use of esbsite.org or any other service run by WSO2, if WSO2 in its sole discretion believes you have: (i) violated or tried to violate the rights of others; or (ii) acted inconsistently with the spirit or letter of these Terms of Service or the Community Guidelines. In such event, your esbsite.org account may be suspended or cancelled immediately in our discretion, all the information and content contained within it will be deleted permanently and you will not be entitled to any refund of any of the amounts you've paid for such account. WSO2 accepts no liability for information or content that is deleted.
WSO2 also reserves the right to cease offering the esbsite.org service, temporarily or permanently, at any time.
6. INDEMNITY
You agree to indemnify and hold harmless WSO2, and its subsidiaries, affiliates, officers, agents, or other partners, and employees, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of and access to esbsite.org, your violation of the Terms of Service or the Community Guidelines, your violation of any rights of another person or entity, or your violation of any applicable laws or regulations.
7. PRIVACY
Registration Data and certain other information about you are subject to our Privacy Policy. For more information, see our full privacy policy at http://www.esbsite.org/privacy.jsp.
8. AGE REQUIREMENTS FOR USE OF esbsite.org
esbsite.org is available for individuals aged 13 years or older. If you are 13 or older but under the age of 18, you should review these terms and conditions with your parent or guardian to make sure that you and your parent or guardian understand and agree to these terms and conditions.
9. INTELLECTUAL PROPERTY RIGHTS
esbsite.org provides the capacity to store and host member content, including Java Code, XML and Apache BSF scripting language code (e.g. Javascript, Groovy, Ruby etc), XSLT and XQuery transformations, HTML, images and other media, and any other document type. You understand that by uploading and creating content on esbsite.org, that you are the copyright holder or licensee of that content, and by posting that content on esbsite.org, you agree to make that content available under the Apache 2.0 license (http://www.apache.org/licenses/LICENSE-2.0) which allows the content to be used, copied, and modified freely by others. WSO2 reserves the right to provide facilities to apply other types of licenses to user-generated content in the future.
10. LOCATION OF LAWSUIT
By agreeing to these Terms of Service you agree in case of a legal dispute to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California.
